These Terms of Service govern your use of kamilaweder.com and any photography session, project or service booked through it. By browsing this website or booking a session with me, you agree to these terms. Please also read my Privacy Policy, which explains how I handle your personal data.

Who I am

I’m Kamila Weder, a photographer based in Nazéaré, Portugal, trading as Kamila Weder Photography. I offer photography services for families, couples, weddings, engagements, newborns, maternity and events, as well as food, product and personal branding photography for businesses and restaurants.

Using this website

This website and its content, including text, photographs, design and logo, belong to me unless stated otherwise. You’re welcome to browse it, share links to pages, and save images for personal reference. You may not copy, reproduce, republish, scrape or otherwise reuse any content from this site, including photographs, for commercial purposes without my written permission.

I keep this website running to the best of my ability, but I don’t guarantee it will always be available, error free or uninterrupted. Some pages link to third-party sites and services, such as Google Maps, Instagram or payment providers. I’m not responsible for their content or how they handle your data.

Booking a session

Sessions are booked through the contact form, email or WhatsApp. A booking is confirmed once I’ve replied confirming the date and you’ve paid the booking fee described on my Prices page. That page sets out payment methods and the rescheduling and cancellation conditions, which form part of these Terms.

In short: a non-refundable booking fee secures your date exclusively for you. The remaining balance is due as described on the Prices page. One free reschedule is possible with enough notice; changes made later are treated as a cancellation.

For commercial and brand projects, such as food, product, event or personal branding photography, the scope, deliverables, usage rights and price are agreed individually by email before the project starts. That written agreement, together with these Terms, governs the project.

Your right to cancel

If you’re a private consumer booking by distance contract, online, by phone or by message, you generally have a 14-day right to cancel without giving a reason under Portuguese and EU consumer law.

Photography sessions, however, are services tied to a specific date and location, in the same way as a restaurant reservation or an event ticket. Under Article 17(k) of Decreto-Lei n.º 24/2014, this type of service is exempt from the standard 14-day cancellation right once a date has been confirmed. By paying the booking fee, you acknowledge that you’re booking a date-specific session and that the standard cooling-off period doesn’t apply, and that the rescheduling and cancellation conditions on my Prices page apply in full instead.

Exceptional circumstances

Serious, unforeseeable events sometimes happen: a death in the family, a serious accident, hospitalisation, or a comparable emergency. If something like this prevents you from attending your session, contact me as soon as possible. At my discretion, and on presentation of supporting documentation, such as a death certificate, medical or hospital report, or police report, I may waive the usual rescheduling notice period or offer a partial refund beyond what the standard cancellation conditions allow. This is considered case by case and isn’t an automatic right.

Force majeure

Neither of us is responsible for delays or cancellations caused by events beyond reasonable control, including severe weather warnings, natural disasters, fire, serious illness or accident, government restrictions or strikes. If such an event prevents me from carrying out your session, I’ll offer you priority for a new date or a full refund of any amount paid. Ordinary weather, such as clouds, wind or light rain, is not force majeure; this is covered separately by the weather policy on my Prices page.

Delivery & files

Sessions are delivered as professionally edited, high-resolution JPG files through an online gallery, within the timeframes stated on my Prices page. RAW files are not included or available for purchase, as they are unfinished working files. Express delivery is available for an additional fee, as described there.

Copyright & image usage

I hold the copyright to every photograph I create, under Portuguese and EU copyright law. Booking a session does not transfer copyright to you.

When you book a personal session, such as family, couple, wedding, engagement, newborn or maternity, you receive a personal-use licence to print, share and post your photos privately and on social media. Credit is appreciated but not required. You may not sell the images, use them commercially, or present them as your own creative work.

For commercial clients, such as restaurants, brands and businesses, usage rights are agreed individually for each project based on scope, channels and duration of use, and confirmed in writing before the project starts.

Portfolio & marketing use

Photographs from your session may be used in my portfolio, on this website, on social media and in marketing materials, since this is how I showcase my work and attract future clients. If you’d prefer your images not to be used this way, let me know in writing before your session and I’ll respect that.

Liability

I take care to deliver a professional, reliable service, but I can’t be held responsible for circumstances outside my control, including weather, third-party venue or vendor issues, or internet and technical failures affecting file delivery, beyond what’s already covered under Force Majeure above. My liability for any claim related to a session is limited to the amount paid for that session.

Complaints

If something about your session or this website didn’t meet your expectations, email me directly and I’ll do my best to resolve it. If we can’t reach an agreement, you may also contact the competent Portuguese consumer protection authority, the Direção-Geral do Consumidor, for guidance.

Changes to these terms

I may update these Terms from time to time, for example to reflect changes in the law or in how I work. The version published on this page at the time of your booking applies to that booking.

Governing law

These Terms are governed by Portuguese law. Any dispute will be submitted to the competent Portuguese courts, without prejudice to any mandatory consumer protection rights you have under the law of your own country of residence.
